Terms of Use

  1. Information on how to enter and prizes form part of these Terms of Use. Participation in the 'LiteracyPlanet Legends' Competition (“Competition”) deems that these Terms and Conditions have been accepted.
  2. The promoter of the Competition is Intrepica Pty Ltd (ABN 44 128 896 980) of 3/23 Main Street, Varsity Lakes QLD 4227 (“LiteracyPlanet”).

Eligible Entrants & Nominees

  1. Entry is only open to students attending Australian schools, as recognised by the legislated Education Act in each Australian state and territory (“Nominee”).
  2. Nominees must be nominated by a parent, carer, other family member or teacher (“Entrant”).
  3. Entrants must be Australian residents aged 18 years or over, and must read and consent to these Terms of Use.
  4. Employees (and their immediate families) of LiteracyPlanet and agencies associated with this Competition are ineligible to enter. Immediate family means child or step-child (whether natural or by adoption).

Competition Dates

  1. The Competition website is open for entries from 12 February 2017 until midnight AEST 24 March 2017 (“Entry Period”).

How to Enter the Competition

  1. The Competition is a game of skill and chance plays no part in the outcome. To be eligible to win Nominees must be nominated by an Entrant at www.literacyplanet.com/legends (“Website”) during the Competition (refer 'Competition Dates’).
  2. Nominees may be nominated as an individual or as a group.
  3. Nominees must be enrolled at an Australian school at the time of the Competition.
  4. Entrants must choose a category, complete the nomination form and provide supporting visuals requested.
  5. Entrants may access the Website through any compatible computer or device with an internet connection. Supported devices are iPhone 4S or above running iOS 7.1 or above; iPad 2 or iPad Mini or above running iOS 7.1 or above; Android 4.3 or above with a 720p screen or higher resolution; Internet Explorer 9, Chrome 42, Safari 7.1, Firefox 38 or above with Flash Player 21 or above.
  6. There is no fee to enter the Competition.

How to Win the Competition

  1. There are three categories in the Competition: sport, academic and community.
  2. Each valid entry in each category will be considered and judged by LiteracyPlanet.
  3. There are three (3) Winners for the Competition (“Winner”), one Winner for each category.
  4. Winners will be notified by LiteracyPlanet at the start of their school's Term 2, 2017 using the contact details provided by the Entrant in the associated nomination form, and published on the Website and all affiliate websites.
  5. Presentation of Winner prizes will take place at the Winner’s school location during Terms 2 and 3, 2017.
  6. All other prizes will be delivered via mail to the Nominees’ school location during Term 2, 2017.

Prizes

  1. The first eligible 1,000 Nominees will receive a LiteracyPlanet Legends pack valued at $100, containing various items of branded merchandise such as T-shirt, cap, keychains and pens.
  2. All Nominees are eligible to receive Competition merchandise while stocks last.
  3. Three (3) Winners will receive a trophy, $10,000 RRP worth of sport and technology supplies for their school, and a visit to the school by a sporting or media personality associated with the Competition.
  4. Prizes are non-transferable and not redeemable for cash.

Advertising and Links to Other Websites

  1. The Website may contain links to third party sites (“Linked Site”). Linked Sites are not under our control and we are not responsible for the content of any Linked Site or any hyperlink contained in a Linked Site (“Subsequent Site”). We provide these hyperlinks to you as convenience only, and the inclusion of any link does not imply any endorsement of the Linked Site by us or by our directors, officers, agents, employees and contractors. You link to any Linked Site or Subsequent Site entirely at your own risk.
  2. Neither we nor our directors, officers, agents, employees and contractors give any representation or warranty as to the reliability, accuracy or completeness of any Linked Sites or Subsequent Sites, nor do we or they accept any responsibility arising in any way (including negligence) for errors in, or omissions from any Linked Sites or Subsequent Sites.
  3. When entering the Competition, Entrants agree that they are fully responsible for the content they submit. LiteracyPlanet shall not be liable in any way for such content to the full extent permitted by law. LiteracyPlanet may remove any content without notice for any reason whatsoever. Entrants warrant and agree that:
  1. they will not submit any content that is defamatory, obscene, derogatory, unlawful or fraudulent, or that LiteracyPlanet may deem is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;their content shall not contain viruses or cause injury or harm to any person or entity; and
  2. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify LiteracyPlanet for any breach of the above terms.

General

  1. This is a game of skill and chance plays no part in determining the winners.
  2. In the event of war, terrorism, state of emergency or disaster, LiteracyPlanet reserves the right to cancel, terminate, modify or suspend the Competition or suspend or modify a prize.
  3. Incomplete entries will be deemed invalid.
  4. LiteracyPlanet reserves the right, at any time, to verify the validity of entries and to disqualify any Nominee who has been entered into the Competition not in accordance with these Terms of Use or any Entrant who tampers with the entry process. Failure by LiteracyPlanet to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. This Competition relies on Entrants’ and Nominees’ honesty in undertaking the Competition.
  6. Entrants agree to indemnify LiteracyPlanet against:
    1. any claims made by Nominees against LiteracyPlanet or its affiliates in connection with the Competition or the Nominee’s participation in the Competition; and
    2. any losses (including any liability) caused by any act or omission of the Nominee which is inconsistent with these Terms of Use.
  7. Entrants in the Competition acknowledge that they are provided with the opportunity for the Nominee to participate in the Competition, as consideration for their agreement to these Terms of Use
  8. If there is a dispute as to the identity of a Nominee, LiteracyPlanet reserves the right, in its sole discretion, to determine the identity of the Nominee.
  9. LiteracyPlanet’s decision is final and no correspondence will be entered into.
  10. If for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by LiteracyPlanet, then the prize (or that element of the prize) will be forfeited.
  11. If any prize (or part of any prize) is unavailable, LiteracyPlanet, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  12. Total prize pool value is $150,000.
  13. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  14. Entrants consent to LiteracyPlanet and its promotional affiliates including related entities, using the Entrant's entry in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by LiteracyPlanet.
  15. If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of LiteracyPlanet, including but not limited to technical difficulties, unauthorised intervention or fraud, LiteracyPlanet reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Nominee; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
  16. Any cost associated with accessing the Website is the Entrant’s responsibility and is dependent on the internet service provider used.
  17. Nothing in these Terms of Use limits, excludes or modifies or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, LiteracyPlanet (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of Competition.
  18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, LiteracyPlanet (including its respective officers, employees and agents), and its affiliates are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under LiteracyPlanet’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Intrepica) due to any reason beyond the reasonable control of LiteracyPlanet; (d) any variation in prize value to that stated in these Terms of Use; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of a prize.
  19. The laws of Queensland, Australia apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Queensland, Australia.

Personal Information and Privacy Policy

  1. LiteracyPlanet recognises that there may be concerns regarding the collection and use of personal information on the Website.
  2. LiteracyPlanet recognises and values the protection of your personal information, and is aware of its obligations under the Privacy Act 1988 (Cth) and will fulfil its obligations in accordance with this Act.
  3. LiteracyPlanet has implemented this Privacy Policy in order to inform you about how we will collect, store and use personal information, and under what circumstances we may disclose personal information.
  4. LiteracyPlanet collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors and service providers. If the personal information requested is not provided, the Entrant cannot participate in the Competition. By participating in the Competition, each Entrant consents to LiteracyPlanet using and disclosing their personal information to LiteracyPlanet's related entities, agencies and other third parties engaged to provide services in connection with the Competition, for use for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to LiteracyPlanet. Entrants provide this consent until such a time as they withdraw it by giving notice to LiteracyPlanet.
  5. From time to time, LiteracyPlanet may ask you to supply personal information such as your name, gender, address, date of birth, telephone number and email address. Under no circumstances will LiteracyPlanet request or collect any information from you that may disclose your political, religious or philosophical beliefs or affiliations; sexuality; racial or ethnic origin; or criminal convictions.
  6. LiteracyPlanet may also conduct surveys or market research and may seek other information from you from time to time. These surveys will provide information to allow the improvement in the type and quality of service offered to you.
  7. Most commercial websites use ‘cookies’ which are pieces of information that websites send to the browser, and are stored on your computer hard-drive. Cookies make using the Website easier by storing information about your preferences on the Website. This allows the Website to be tailored to you. Cookies will not identify you personally.
  8. If you would prefer not to receive cookies, you can alter your security settings on your web browser to disable cookies or to warn you when cookies are being used. However, by disabling the cookie function in your web browser you may impede your ability to use parts of the Website.
  9. Providing us with your personal information is absolutely optional. When you provide us with your personal information, you are consenting to our storage, use and disclosure of that information as outlined in this Privacy Policy
  10. We may from time to time run competitions or offer additional benefits to you, and we may ask you to provide us with your personal details for these purposes. Providing us with this information is optional. However, not providing your personal information means we may not be able to contact you or offer you access to additional benefits.
  11. You may opt out from our continued communications at any time by e-mailing us. To unsubscribe from our e-mail database, please send an e-mail to unsubscribe@literacyplanet.com, using "UNSUBSCRIBE" in the subject line of the e-mail.
  12. Your personal information, including your e-mail address, will be used to ensure the proper functioning of the Website; and to assist us with our marketing, planning, product development and research requirements.
  13. We will not use or disclose (or permit the use or disclosure of) personal information that could be used to identify an individual member in any circumstances except:
    1. to ensure the proper functioning of our business in relation to the person in question (for example, to confirm your acceptance of the Terms of Use);
    2. to communicate promotional offers and special events to you;
    3. to avoid risks to health and safety of an individual or society at large;
    4. where the law requires us, or authorises us to do so;
    5. where you have given express consent to us for a prescribed purpose.
  14. We will not sell, distribute, rent, licence, disclose, share or pass your personal information onto any third parties, other than those who are contracted to us to keep the information confidential, whether subject to a statute or a scheme which imposes similar restrictions to the National Privacy Principles contained in the Privacy Act 1988 (Cth) regarding the handling of personal information.
  15. We will take all reasonable steps to ensure that all information collected from you is accurate, up to date, complete and stored in a secure environment and accessed only by our authorised personnel.
  16. Please note that no information transmitted over the Internet can be guaranteed to be 100% secure. We will endeavour to protect your personal information as best as possible, but we cannot guarantee the security of any information that you transmit to us, or receive from us. The transmission and exchange of information is carried out at your own risk.
  17. The personal information supplied by entrants entering this Competition will be used by LiteracyPlanet in accordance with this Privacy Policy and these Terms of Use. Entry in this Competition is an agreement to be bound by that policy.
  18. All entrants may have their details removed from LiteracyPlanet’s database by contacting LiteracyPlanet or by sending an email to privacy@literacyplanet.com. If details are removed prior to the conclusion of the Competition and/or award of prize(s), entrants will forfeit their right to claim any prizes.
  19. You have the right to access the information that you provide to us.If you wish to access, modify or remove any personal information that you have provided to us, please contact our Privacy Officer at privacy@literacyplanet.com.
